Terms of Service for Budgt

1. Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "User") and the developer of Budgt ("Budgt," "we," "us," or "our") governing your access to and use of the Budgt mobile application (the "App"), available on Google Play and the Apple App Store.

By downloading, installing, accessing, or using Budgt, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not use the App.

2. Eligibility

To use Budgt, you must:

  • Be at least 13 years of age (or the minimum age of digital consent in your country, if higher)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the App under the laws of your jurisdiction

If you are using the App on behalf of a minor who meets the applicable minimum age, you represent that you are their parent or legal guardian and consent to their use of the App under your supervision.

3. User Accounts

To access most features of Budgt, you must create an account using either Google Sign-In or email-based authentication. When creating and maintaining your account, you agree to:

  • Provide accurate information where requested
  • Keep your login credentials confidential
  • Notify us promptly if you suspect unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

We use Firebase Authentication to manage sign-in and account security. You are solely responsible for maintaining the security of the device and credentials used to access your account.

4. Acceptable Use

You agree to use Budgt only for its intended purpose — personal financial tracking and budgeting — and agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to our systems, other users' accounts, or our backend infrastructure (including Firebase/Firestore)
  • Reverse engineer, decompile, or disassemble the App, except where such restriction is prohibited by law
  • Interfere with or disrupt the App's functionality, servers, or networks
  • Use automated systems (bots, scrapers, etc.) to access or interact with the App
  • Upload or input any content that is unlawful, fraudulent, defamatory, or infringes on the rights of others
  • Use the App to launder money, commit fraud, or engage in any other illegal financial activity
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

We reserve the right to investigate and take appropriate action against anyone who violates this section, including suspending or terminating their account (see Sections 12 and 13).

5. User Responsibilities

You are solely responsible for:

  • All financial data, transaction records, budgets, goals, and other content you enter into the App ("User Content")
  • The accuracy and completeness of the User Content you provide
  • Any decisions you make based on the reports, summaries, or insights generated by the App from your User Content
  • Maintaining your own independent backups of important financial records, since Budgt is a personal organizational tool and not a system of record for legal, tax, or accounting purposes

6. Financial Disclaimer

Budgt is a personal budgeting and expense-tracking tool. It is designed to help you organize and visualize financial information that you manually enter. Budgt is not a bank, financial institution, broker, financial advisor, tax advisor, or accounting service, and nothing in the App constitutes financial, investment, tax, legal, or professional advice.

Specifically:

  • We do not connect to your bank accounts, credit cards, or other financial institutions to automatically retrieve transaction data.
  • Any budgets, reports, projections, or summaries generated by the App are based solely on the data you enter and are provided for informational and organizational purposes only.
  • We do not guarantee the accuracy, completeness, or reliability of any calculations, categorizations, or reports produced by the App.
  • You should not rely on Budgt as your sole source of information for making significant financial, investment, or tax decisions. Consult a qualified professional for advice specific to your situation.

You use the App's financial tracking features entirely at your own risk and discretion.

7. Data Accuracy

Because Budgt relies entirely on data that you manually enter, the accuracy of your wallets, transactions, budgets, goals, and reports depends on the accuracy and completeness of the information you provide. We are not responsible for errors, omissions, or inaccuracies in your records resulting from incorrect data entry, missed entries, or misuse of the App's features.

8. Intellectual Property

The App, including its design, source code, graphics, logos, icons, and overall look and feel (excluding your own User Content), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a personal device that you own or control, solely for your personal, non-commercial use, in accordance with these Terms and the applicable app store's terms of service.

You retain all ownership rights to the User Content you enter into the App (your wallets, transactions, budgets, goals, notes, etc.). By using the App, you grant us a limited license to store, process, and display that User Content solely as necessary to operate and provide the App's features to you.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any portion of it, except as expressly permitted by these Terms or applicable law.

9. Service Availability

We aim to keep Budgt available and functioning correctly, but we do not guarantee that the App will be uninterrupted, error-free, or available at all times. The App depends on third-party infrastructure, including Firebase and Google Cloud services, as well as your device's operating system and internet connectivity, all of which are outside our direct control.

We may, at our discretion and without prior notice, modify, suspend, or discontinue any feature or part of the App (temporarily or permanently) for reasons including maintenance, updates, technical issues, or changes to our business. We will make reasonable efforts to notify users of significant planned downtime or discontinued features where practical.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Budgt is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the App will be error-free, secure, or that any errors will be corrected.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or financial loss, arising out of or in connection with your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
  • Our total aggregate liability arising out of or relating to these Terms or your use of the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the event giving rise to the claim (or a nominal amount, such as USD $50, if you have not paid us anything, where permitted by law).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

11. Account Suspension

We reserve the right to suspend your access to your account, temporarily, if we reasonably believe that:

  • You have violated these Terms, including the Acceptable Use provisions in Section 4
  • Your account poses a security risk to you, other users, or the App
  • Suspension is necessary to investigate suspected misuse or unlawful activity
  • Suspension is required to comply with a legal obligation

Where practical, we will attempt to notify you of the suspension and the reason for it. A suspension is not necessarily permanent and may be lifted once the underlying issue is resolved.

12. Account Termination

By you: You may stop using the App and delete your account at any time using the in-app deletion option (where available) or by contacting us at the email address listed in Section 15. Account deletion is also described in our Privacy Policy.

By us: We may terminate or permanently disable your account if:

  • You seriously or repeatedly violate these Terms
  • We are required to do so by law
  • We discontinue the App entirely
  • Your account has been inactive for an extended period, subject to reasonable notice where practical

Upon termination, your right to use the App will immediately cease, and we may delete your account data in accordance with our Privacy Policy's data retention practices.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles, except to the extent that mandatory consumer protection laws of your country of residence provide otherwise and cannot be waived.

Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California, unless applicable law requires otherwise.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in the App, our practices, or legal requirements. When we make material changes, we will update the "Last Updated" date at the top of these Terms and, where appropriate, provide notice through the App. Your continued use of Budgt after any such changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
